Cumhurbaşkanlığı Hükûmet Sistemi'nin Bürokratik İşleyişe Etkilerinin Mevzuat Açısından Analizi

Türkler, tarih boyunca güçlü bir devlet geleneği oluşturmuş; farklı dönemlerde kurdukları devletlerde yönetim anlayışlarını tarihî birikimleri ile içinde bulundukları coğrafi ve siyasi koşullar doğrultusunda şekillendirmiştir. Cumhuriyet’in ilanıyla birlikte Türkiye’de modern devlet yapılanması benimsenmiş, tek parti yönetimi, çok partili hayata geçiş, 1960 ve 1980 askerî müdahaleleri sonrasında gerçekleştirilen anayasal ve yönetsel düzenlemeler ile yönetimde etkinlik ve koordinasyonu artırmaya yönelik reformlar Türk yönetim sisteminin dönüşümünde belirleyici olmuştur. Bu süreçte demokratikleşme ve merkezileşme eğilimleri birbirini etkileyen iki temel dinamik olarak gelişmiş; kamu yönetiminin örgütlenmesi ve bürokratik işleyişi de bu dönüşümden doğrudan etkilenmiştir. Tarihsel gelişim, 2017 yılında parlamenter sistemden Cumhurbaşkanlığı Hükûmet Sistemine geçilmesiyle yeni bir aşamaya ulaşmış ve Türk yönetim sisteminin hukuki ve kurumsal yapısında kapsamlı değişiklikler gerçekleştirilmiştir. Literatürde Cumhurbaşkanlığı Hükûmet Sistemine ilişkin çalışmaların büyük bölümü siyasal sistem, kuvvetler ayrılığı ve kamu yönetimi üzerindeki etkiler üzerinde yoğunlaşırken, sistemin bürokratik işleyişe etkilerini anayasal ve yasal düzenlemeler çerçevesinde bütüncül biçimde inceleyen çalışmaların sınırlı olduğu görülmektedir. Bu doğrultuda çalışma, başta Türkiye Cumhuriyeti Anayasası olmak üzere Cumhurbaşkanlığı Hükûmet Sistemine geçiş sürecinde değiştirilen temel anayasal ve yasal düzenlemeleri sistematik olarak inceleyerek bu boşluğu doldurmayı amaçlamaktadır. Çalışmada, nitel araştırma yöntemlerinden doküman analizi yöntemi kullanılmıştır. Yapılan değerlendirmeler sonucunda, yeni sistemle birlikte bürokraside karar alma süreçlerini hızlandırmak, kurumsal yapıyı sadeleştirmek ve yürütmede koordinasyonu güçlendirmek amacıyla anayasal ve yasal düzeyde kapsamlı değişikliklerin gerçekleştirildiği tespit edilmiştir. Bu kapsamda Cumhurbaşkanlığı Hükûmet Sistemi, yürütme yetkisinin merkezileştirilmesi, bürokratik örgütlenmenin yeniden yapılandırılması ve kamu yönetiminin karar alma mekanizmalarının yeniden düzenlenmesi bakımından önemli değişiklikler getirmiştir. Bununla birlikte, bürokratik etkinliğin yalnızca mevzuat değişiklikleriyle sağlanamayacağı; hukuki düzenlemelerin uygulamadaki sonuçları, kurumlar arası koordinasyon, idari kapasite, dijitalleşme düzeyi, insan kaynağının niteliği ve hesap verebilirlik mekanizmalarının etkinliğinin de kamu yönetiminin performansını doğrudan etkilediği sonucuna ulaşılmıştır.

Öz (English)

Throughout history, Turks have established a strong tradition of statehood, in the states they founded during various periods, they shaped their approach to governance in accordance with their historical heritage and the geographical and political conditions in which they found themselves. With the proclamation of the Republic, a modern state structure was adopted in Turkey. Furthermore, the transition from single-party rule to a multi-party system, along with the constitutional and administrative reforms implemented following the 1960 and 1980 military interventions and those aimed at enhancing efficiency and coordination in governance, played a decisive role in transforming the Turkish administrative system. During this process, trends towards democratisation and centralisation developed as two fundamental, mutually influencing dynamics; the organisation of public administration and bureaucratic operations were also directly affected by this transformation. This historical development reached a new stage in 2017 with the transition from the parliamentary system to the Presidential System of Government, resulting in comprehensive changes to the legal and institutional structure of the Turkish governance system. While the majority of studies in the literature on the Presidential System of Government focus on its effects on the political system, the separation of powers, and public administration, studies examining the system’s impact on bureaucratic functioning within the framework of constitutional and legal provisions remain limited. Therefore, a comprehensive analysis of this dimension is needed. Accordingly, this study aims to fill this gap by systematically examining the fundamental constitutional and legal provisions amended during the transition to the Presidential System of Government, particularly focusing on the Constitution of the Republic of Turkey. The study utilises the document analysis method, one of the qualitative research methods. Following the assessments carried out, it has been established that, alongside the new system, comprehensive changes have been implemented at the constitutional and legislative levels with the aim of speeding up decision-making processes within the bureaucracy, simplifying the institutional structure and strengthening coordination within the executive. In this context, the Presidential System of Government has introduced significant changes in terms of the centralisation of executive authority, the restructuring of the bureaucratic organisation and the reorganisation of decision-making mechanisms within public administration. However, it has been concluded that bureaucratic efficiency cannot be achieved through legislative changes alone; the practical outcomes of legal regulations, inter-agency coordination, administrative capacity, the level of digitalisation, the quality of human resources and the effectiveness of accountability mechanisms also directly affect the performance of public administration.
